Terms and Conditions

1. Agreement

By creating an account or using ASM ("the Service"), you agree to these Terms and Conditions. The Service is operated by Talus Cyber LLC ("Company," "we," "us"). If you do not agree to these terms, do not use the Service.

2. Description of Service

ASM is a cloud-based platform for managing game dedicated servers. The Service provides server monitoring, player management, RCON integration, live mapping, metrics, ticketing, and team collaboration tools. The Service currently supports Arma 3 with additional game support planned.

3. Accounts

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account credentials, including your password and two-factor authentication codes.
  • You must not share your account with others or allow unauthorized access.
  • You must be at least 18 years old to create an account.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Organizations

  • Organizations are the primary unit of access and billing on the platform.
  • Organization owners are responsible for the actions of all members within their organization.
  • Organization owners may invite members, assign roles, and manage billing.
  • When an organization is deleted, all associated data (servers, hosts, agents, bans, logs, tickets, telemetry) is permanently and irreversibly removed.

5. Subscriptions and Billing

  • The Service offers free and paid subscription tiers with different feature and resource limits.
  • Paid subscriptions are billed through Stripe. By subscribing, you also agree to Stripe's terms of service.
  • Subscriptions renew automatically at the end of each billing period unless cancelled.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact support for refund requests.
  • We reserve the right to change pricing with 30 days notice to existing subscribers.
  • If payment fails, your organization may be downgraded or deactivated after a grace period.

6. Acceptable Use

You agree not to:

  • Use the Service to violate any laws or regulations.
  • Attempt to gain unauthorized access to other users' accounts, organizations, or data.
  • Use the Service to harass, abuse, or harm others.
  • Attempt to reverse engineer, decompile, or extract the source code of the platform.
  • Use automated tools to scrape, crawl, or extract data from the Service beyond the provided APIs.
  • Resell, redistribute, or sublicense access to the Service without written permission.
  • Use the SQF console or RCON features to execute malicious code on game servers you do not own or have authorization to manage.
  • Circumvent plan limits, feature gates, or access controls.
  • Interfere with or disrupt the Service or its infrastructure.

7. Game Server Data

  • You are responsible for ensuring you have the right to manage the game servers you connect to the platform.
  • Player data collected through the Service (names, IPs, Steam IDs, chat messages) is your responsibility to handle in compliance with applicable privacy laws.
  • We are not responsible for how you use player data or the actions you take on your game servers through the platform.
  • The @asmAgent server mod must be installed with the game server owner's consent.

8. Intellectual Property

  • The Service, including its code, design, and documentation, is the intellectual property of Talus Cyber LLC.
  • You retain ownership of your data (server configurations, player notes, tickets, etc.).
  • You may not copy, modify, distribute, or create derivative works of the Service.
  • ASM is not affiliated with Bohemia Interactive, the developer of Arma 3.

9. Availability and Support

  • We aim to maintain high availability but do not guarantee uninterrupted access to the Service.
  • Scheduled maintenance will be communicated in advance when possible.
  • Support is provided through the in-platform ticketing system.
  • Priority support is available on the Ultra plan tier.

10. Limitation of Liability

The Service is provided "as is" without warranty of any kind, express or implied. To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
  • We are not liable for loss of data, revenue, or profits arising from use of the Service.
  • We are not liable for actions taken on game servers through the platform (kicks, bans, SQF execution, etc.).
  • Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Talus Cyber LLC, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

12. Termination

  • You may terminate your account at any time by contacting support.
  • We may suspend or terminate your account for violation of these terms with or without notice.
  • Upon termination, your right to use the Service ceases immediately.
  • We may retain certain data as required by law or for legitimate business purposes.

13. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the state in which Talus Cyber LLC is incorporated. Any disputes arising from these terms shall be resolved in the courts of that jurisdiction.
